The Phantom Store website and services (the “Phantom Store”) is owned and operated by Phantom Technologies, Inc. (“Phantom,” “we,” or “us”). This Phantom Store Privacy Policy describes how we collect, use, disclose, and otherwise process information about you when you access, visit, or purchase goods or merchandise at our Phantom Store, including on our Phantom Store website and other online products and services that link to this Phantom Store Privacy Policy (collectively, our “Services”). This Phantom Store Privacy Policy does not apply to information Phantom collects or processes in connection with its crypto trading platform, located at https://phantom.com, or services associated with that platform, including our crypto app (collectively, the “Phantom Wallet Services”). More information on how we collect and handle data relating to the Phantom Wallet Services is available at https://phantom.com/privacy (the “Phantom Wallet Privacy Policy”). We may provide different or additional notices of our privacy practices for certain other offerings, in which case those notices will supplement or replace the disclosures in this Phantom Store Privacy Policy.
We may change this Phantom Store Privacy Policy from time to time. If we make material changes, we will notify you by revising the date at the top of this policy. If we make material changes, we will provide you with additional notice (such as by adding a statement to the Services or sending you a notification). We encourage you to review this Phantom Store Privacy Policy regularly to stay informed about our information practices and the choices available to you.
COLLECTION OF INFORMATION
The information we collect about you depends on how you interact with us. In this section, we describe the categories of information we collect and the sources of this information.
Information You Provide to Us
We collect information you provide directly to us. For example, we collect information directly from you when you make a purchase, fill out a form, submit or post content through our Services, communicate with us via third-party platforms, participate in a contest, sweepstakes, or promotion, sign up for rewards or marketing communications from us, request customer support, or otherwise communicate with us. The types of information that we collect directly from you include your name, email address, billing address, shipping address, phone number, and any other information you choose to provide.
When you make a purchase from the Phantom Store, we work with our third-party e-commerce provider Shopify to process your payment information, including your credit card, debit card, or other payment details. Phantom does not collect, store, or process payment or financial information.
Information We Collect Automatically
We automatically collect information about your interactions with us or our Services, including:
- Transactional Information: When you make a purchase, exchange, return, or cancel an order, we collect information about the transaction, such as product details, purchase price, and the date of the transaction.
- Device, Usage, and Activity Information: We collect information about how you access our Services, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, browser type, and unique device identifiers. We also collect information about the route by which you access our Services, access dates and times, and your activity on our Services, such as pages viewed, links clicked, and items placed in your cart or added to your wish list.
- Information Collected by Cookies and Similar Tracking Technologies: We use tracking technologies, such as cookies and pixels, to collect information about your interactions with the Services and our marketing communications. These technologies help us improve our Services and marketing communications, personalize your experience, and analyze your interactions with us, including to see which areas and features of our Services are popular and count visits. They also allow us to recognize and alert you if you leave items in your shopping cart. Information We Collect from Other Sources
We obtain information from other sources. For example, we may collect information from Shopify and data analytics providers. This information includes information about your interactions with the Shopify merchants, including Phantom and Gemnote.
Additionally, if you access the Phantom Store through a third-party platform (such as Google), we will have access to certain information from that platform, such as your name and email address, in accordance with the authorization procedures determined by such platform.
Information We Derive
We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your clothing preferences based on your browsing behavior and past purchases or infer that you are looking to purchase certain products based on items you have viewed or added to your cart.
COLLECTION OF INFORMATION BY SHOPIFY AND GEMNOTE
Our third-party e-commerce provider Shopify collects and processes certain information on our behalf to help us make available, operate, and improve the Phantom Store, including hosting services. In addition, Shopify collects information directly from you about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the collection and processing of your personal information in accordance with its Shopify Consumer Privacy Policy located at https://www.shopify.com/legal/privacy, and for responding to your requests to exercise your rights over use of your personal information for these purposes. Depending on where you reside, you may exercise certain rights with respect to your personal information through the Shopify Privacy Portal. To help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data provided by Shopify.
Our third-party logistics partner and support services provider Gemnote handles our order fulfillment, shipping, returns, and exchanges. Gemnote processes your order details including your name, shipping address, phone number, email address, and other information to fulfill and deliver your orders and to facilitate any returns or exchanges for Phantom. In some cases, we will direct you to contact Gemnote directly relating to questions about your order. For questions regarding the handling of your personal information by Gemnote, please contact phantom@gemnote.com.
USE OF INFORMATION
We use the information we collect to process and fulfill your orders and market our products to you. We also use the information we collect to:
- Provide, maintain, and improve our Services;
- Develop new products and services;
- Personalize your experience with us;
- Send you technical notices, security alerts, support messages, and other transactional or relationship messages;
- Run and operate our business. If you engage with us through the Phantom Store and also through the Phantom Wallet Services, we may use your information across both services for any purpose described in this privacy policy or the Phantom Wallet Privacy Policy.
- Send you marketing communications about any Phantom products or services (see the Your Choices section below for information about how to opt out of these communications at any time);
- Monitor and analyze trends, usage, and activities in connection with our products and services;
- Facilitate contests and promotions and process and deliver entries and rewards;
- Detect, investigate, respond to, prosecute, and help protect against security incidents and other malicious, deceptive, fraudulent, or illegal activity, and help protect the rights and property of Phantom and others;
- Comply with our legal and financial obligations;
- Create de-identified and aggregate data that cannot reasonably be linked to you; and
- Fulfill any other purpose for which you consent or direct.
DISCLOSURE OF INFORMATION
We disclose information about you in the following ways:
- Vendors and Service Providers. We make personal information available to our vendors, service providers, contractors and consultants who perform services on our behalf, such as companies that assist us with web hosting and payment processing (including Shopify), shipping and delivery (including Gemnote), fraud prevention, customer service, analytics, and marketing.
- Law Enforcement Authorities and Individuals Involved in Legal Proceedings. We disclose personal information in response to a request for information if we believe that disclosure is in accordance with, or required by, any applicable law, regulation, or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.
- To Protect the Rights of Phantom and Others. We may disclose personal information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Phantom, our users, the public, or others.
- Professional Advisors. We disclose personal information to our legal, financial, insurance, and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
- Corporate Transactions. We disclose personal information in connection with, or during negotiations of, certain corporate transactions, including a merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
- With Your Consent or at Your Direction. We make personal information available to third parties when we have your consent or you intentionally direct us to do so. For example, if you direct us to share your order details with another individual.
We also disclose aggregated or de-identified information that cannot reasonably be used to identify you. We maintain and use this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.
YOUR CHOICES
You can access, correct, and delete certain information stored by Phantom at any time by contacting privacy@phantom.app. You may opt out of receiving text messages or promotional emails from Phantom by following the instructions in those communications or by contacting privacy@phantom.app. If you opt out, we may still send you non-promotional communications, such as those about your orders.

Data Retention
We store personal information associated with your order for as long as necessary to carry out the purposes for which we originally collected it and for other business purposes explained in this Phantom Store Privacy Policy.
Individuals Residing in Certain U.S. States
Some U.S. states have enacted privacy laws that grant their residents certain rights and require specific disclosures (“State Privacy Laws”). We generally do not collect information that is considered “sensitive” under State Privacy Laws, and we do not use or disclose sensitive personal information for the purpose of inferring characteristics about you.
As described in the Collection of Information section above, we collect personal information from various sources, including directly from you, automatically when you access or use our Services, and from third-party sources.
We retain personal information as described above. We do not collect, use, or sell personal data for the purpose of training large language models.
We do not use personal information for “targeted advertising,” “selling,” or “sharing” as those terms are defined under State Privacy Laws, including personal information about consumers we know to be under the age of 18.
Your Rights under State Privacy Laws
Access, Correction, and Deletion
You have the right to (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information. Residents of Connecticut, Minnesota, Oregon, and Rhode Island may request a list of third parties to whom we have disclosed your personal data or any personal data.

Nondiscrimination
We will not discriminate against you for exercising your privacy rights.
Appeals
If we deny your request, you may appeal our decision by contacting us at privacy@phantom.app. If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.
Authorized Agents
If you reside in California, you may also designate an authorized agent to submit an access, deletion, or correction request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may contact the individual who is the subject of the request to verify such individual’s own identity or confirm the authorized agent has permission to submit the request. International Transfers
Phantom is based in the United States, and we and our service providers process and store personal information on servers located in the United States and other countries. If you access the Services from outside the United States, you understand that we may transfer your information to the United States, which may provide fewer protections for your personal information than your jurisdiction of residence. Whenever we make restricted international transfers of personal information, we take steps designed to ensure that your personal information receives an adequate level of protection (by putting in place appropriate safeguards, such as contractual clauses) or ensure that we can rely on an appropriate derogation under data protection laws.

Legal Basis for Processing
When we process your personal data as described in this Phantom Store Privacy Policy, we do so in reliance on the following lawful bases:
- To perform our responsibilities under our contract with you (e.g., processing payments for and providing the products and services you requested);
- When we have a legitimate interest in processing your personal data to operate our business or protect our interests (e.g., to provide, maintain, and improve our products and services, conduct data analytics, to combat fraud and maintain security, and communicate with you);
- To comply with our legal obligations (e.g., to maintain a record of your consents and track those who have opted out of marketing communications); or

Consent
By submitting personal information to Phantom, our service providers, or our agents, you consent to the collection, use, disclosure, and transfer of your personal information in accordance with this Phantom Store Privacy Policy and as permitted or required by law.
You may withdraw your consent at any time to the collection, use, disclosure, or transfer of your personal information by contacting Phantom as set forth in the Contact Us section below. If you withdraw your consent (or if you decide not to provide certain personal information), you acknowledge that Phantom may not be able to provide you, or continue to provide you, with our Services or information that may be of value to you.
Access and Correction
You have the right to (1) request to know more about and access your personal information and (2) request correction of inaccurate personal information. Canada’s Anti-Spam Law
Phantom will only send you commercial electronic messages (“CEMs”) where we have your express or implied consent to do so. Your consent to receive CEMs is implied where we have an existing business relationship with you, or you have reached out to us and made an inquiry within a certain time frame. You may unsubscribe from receiving CEMs at any time by clicking the unsubscribe link on an email. If you opt out, we may still send you non-promotional messages, such as those about your order or our ongoing business relations.
Transfers out of Canada/Quebec
Your personal information may be stored, accessed, used and otherwise processed inside and outside of Quebec and/or Canada. When personal information is located outside Quebec and/or Canada, it may be subject to laws that have different standards of protection and may allow for foreign law enforcement and governmental access.
Automated Decisions and Residents of Quebec
If you are a resident of Quebec, we will inform you if we exclusively use automated processing to render a decision about you. You may also request information about the personal information used to make that decision, and request that the information be corrected.
